Arbitration and Mediation

Arbitration and mediation are simply ways of settling disputes without going to court. They can be beneficial to both sides of the disputing parties as they tend to be settled faster and are less costly than going to court.

ARBITRATION

Arbitration is when a third party, known as the arbitrator, makes a judgment siding with one of the two disputing parties. An arbitrator is a licensed professional, usually a lawyer or former judge. In most cases, an arbitration judgment is binding; however, it can be nonbinding.

Just like in court, an arbitrator will hears both sides of the argument and all the evidence, and then he will make a decision.  Arbitrators do not try to compromise with the two parties; they make a judgment in favor of one party.

You have the right to be represented in arbitration.

Arbitration is not a court case in front of a judge; there are similarities as well as differences.  You do have the right to be represented.  Campbell & Campbell will not only explore all avenues of your situation and ensure your claims are heard and addressed, but will also explain to you the process and steps being taken on your behalf.  We know it can be intimidating when you are facing a business or large corporation, and we will lead you through the process from start to finish—from who requests the arbitration and pays the initial costs (generally the business) through the judgment. We will explain if the judgment is binding, as in most cases, or nonbinding.  If it is nonbinding, we will be there to guide you through the next steps.

Even though arbitration was originally introduced into contracts as a benefit of the business or corporation, it has evolved to become an excellent way to expedite claims and reduce costs and is thus beneficial to all parties involved.

MEDIATION

Mediation is when a third party, the mediator, supervises negotiations between two disputing parties. A mediator is a certified professional who can be a lawyer or a licensed counselor. Mediation can be binding or non-binding.

During mediation either party or the mediator will suggest comprises to resolve the issue or issues.  Campbell & Campbell will be there to listen to your concerns and claims as well as calm your fears and emotions over the situation.  We will also collaborate with the mediator on your behalf to assure your needs and wants are addressed appropriately.  When both parties have reached an agreement concerning all the issues of the case, the case is settled.
